a) Anmeldung.

1 Who we are

The Abrigua app is provided by:

Marisma GmbH, Stepackerstrasse 12, 8194 Hüntwangen, Switzerland

Commercial register: CH-020.4.019.976-5

2 How the app works and who is responsible for your data

Abrigua is the app for an Abrigua system that runs in the house and controls the pool, irrigation, energy, alarm, lights and climate there. The app connects only to that system, whose address is set in the app. It does not work without such a system.

3 What data the app processes

a) Sign-in. You sign in in the app on the sign-in page of your system, with email address, password and confirmation code. This information goes only to your system. The app does not store your password, code or PIN.

b) Registering the phone. After you sign in, the app registers the phone with your system. The system stores:

You and the owner of the system see your phones in the web interface under "Mein Zugang" (My access). When a new phone is registered, the system sends an email to you and to the owners. The data is kept until you sign out the phone, the owner blocks it or your account is deleted. A blocked phone stays visible to the owner in the list but receives nothing any more.

c) Arrive and leave (location). Only if you agree and iOS allows location access "Always": iOS watches on your phone whether you enter or leave the home zone around the house. The app then sends only the event "arrived" or "left" to your system, with the time, a random identifier and a signature of the phone. No coordinates, no routes and no location history are sent. The system uses the event so that the alarm does not arm while someone is at home. The system keeps the random identifier for 24 hours to detect duplicates. The event may appear in the automation log of the system (person, event, time); such entries are deleted after at most 90 days by default. The centre and radius of the home zone are data about the house; the app loads them from the system and stores them on the phone. You can withdraw your consent at any time in the app settings; the app then stops sending events.

d) Notifications. If you allow notifications, your system sends alerts (for example an alarm or a leak) to your phone through the Apple Push Notification service (APNs). In the current version the notification contains the title and text of the alert; this content passes through Apple's servers. If you acknowledge an alert from the notification, the app reports it to your system. You turn notifications off in the iOS settings.

e) Using the app. The app shows the controls as a web view of your system's interface. What your system states applies; the web view stores the session (cookies) on the phone. Camera pictures are not cached. When you sign out, the app deletes the web view's data.

f) On your phone. The app stores on the phone: the private key (in the Secure Enclave, no iCloud backup), the address of your system and the phone's identifier, your app settings, the home zone and, briefly, events not yet delivered. Access tokens are kept in memory only. The optional app lock with Face ID is handled by iOS; the app only gets the result, never your face data.

g) Technical logs. Your system logs sign-ins, refused requests and access to the system (for example time and IP address) to protect it against misuse. The operator of the system decides how long these logs are kept.

4 What the app does not do

Crash reports are optional: we only receive them if you have turned on "Share with App Developers" in the iOS settings. Apple provides them to us through App Store Connect. They contain technical data about the device and the app, but not your name or contact details. We use them only to fix errors. The legal basis is your consent through this iOS setting (Art. 6(1)(a) GDPR); you can turn it off there at any time.

There is no automated individual decision-making or profiling within the meaning of Art. 22 GDPR or Art. 21 FADP. The automations of the system (for example that the alarm does not arm while someone is at home) are house control functions chosen by the operator. They are not decisions about persons with legal effect.

6 Legal bases

Where the General Data Protection Regulation (GDPR) applies: the functions of the app are based on the use you choose (Art. 6(1)(b) GDPR); "arrive and leave" and notifications on your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time; protection against misuse on the legitimate interest in safe operation (Art. 6(1)(f) GDPR). In Switzerland the Federal Act on Data Protection (FADP) applies; processing under the FADP serves the same purposes.

7 Your rights

You have the right of access, rectification, erasure, restriction of processing, data portability and objection, and the right to withdraw consent. You delete your account yourself in the app (app settings, "Delete account") or in the web interface under "Mein Zugang" (My access); this deletes your account, your sign-in data and all your phones. For data in your system, contact its operator; we are happy to help: info@marisma.com.

You can lodge a complaint with a supervisory authority: in Switzerland the Federal Data Protection and Information Commissioner (FDPIC), in Spain the Agencia Española de Protección de Datos (AEPD), otherwise the authority where you live.

8 Children

The app is meant for owners and family members of a home with an Abrigua system. The owner grants access.

9 Changes

We update this policy when the app changes, for example if access from away through Marisma services is added later. The version published here applies.
